Regarding COPPA

The Children's Online Privacy and Protection Act is a set of US laws designed to protect children under the age of 13 and their interactions with the Internet and various communities on the Internet.

Being that we are a US company (Based out of McKinney, Texas), we are familiar with the regulations under COPPA and while we DO NOT immediately fall under the jurisdiction of COPPA, we still felt it right to articulate our posture with regards to COPPA and how seriously we take children's safety on the Internet.

First and foremost, we are not a site designed or targeted at anyone under the age of 13.

We don't collect any information from any users until they sign up for our platform. During the sign up process we require each user to check a box stating they are over the age of 13, and agree to our Terms of Use, Privacy Policy, and Community Guidelines. Our Privacy Policy explicitly state that Mechanyx.gg "is only available to individuals who are at least 13 years of age. For individuals in the EU member states and subject to GDPR the Site is only available to those over the age of 16 years of age."

Further, we have a field in our sign up process that asks those signing up what their birthday is. We then check the value they entered against the current date to validate if the user is 13 years of age. Any user trying to sign up using a birth date less than 13 years ago is not able to create an account or proceed further.

2. We collect minimal PII data. Very minimal PII data.

Seriously - we only log a username that the user picks on their own, and a token from our authentication partner Auth0 (see below). No full names. No addresses. No geographic data. Just a user name. Further, we give each user a unique hash which we use to identify them with. It's the case that in many of our data entries no record exists of the user beyond a hash of jumbled letters and numbers.

Some features of Mechanyx.gg are driven by text messages. In which case we collect a phone number and store it along side the user's unique hash. Again this user hash simply ties back to a token and the user's username. No other personally identifiable information (PII) is stored adjacent to this data.

During checkout for ToTheCause contributions and other payment flows on Mechanyx.gg, you are asked to provide an email address for receipts. This information is stored so we can send you a receipt. Causes and those using ToTheCause are also able to see this email address by way of Stripe's dashboard. It is expressly forbidden by our Terms of Use for anyone using ToTheCause or any other services of Mechanyx.gg which allow access to your email to sell, distribute, or otherwise export said address for use anywhere else.

Naturally we expect everyone who uses ToTheCause to adhere to these rules - but we're also not dumb. Ever. We don't run ads. We don't sell data. We don't give data away for any reason at any time. User privacy is one of the most important aspects of our business.

We do use two third party services: specifically Auth0 (A well known authentication service which we use to authenticate our users) and Stripe (a well-known payment processing platform).

Auth0 collects their own sets of data for the purposes of authenticating their users and providing functionality to us - but we don't store any personally identifiable information from Auth0 beyond simply a basic user token which is given to us for the purpose of identifying someone who signs into our site.

This token does not contain any names or other personally identifiable information - and it is only ever stored alongside the user's username and their unique user hash.

It's worth noting that Auth0 when authenticating a user will send us a packet of information with other information in it such as the user's reported first and last name. But we do not store this information anywhere in our servers, and we never distribute it to third parties or anyone outside of our team.

Stripe collects payment information for the purposes of validating and processing a transaction. In this case personally identifiable information such as the customer's name and card information is stored securely on Stripe's servers.

For the purposes of legal compliance, we do keep a record of every transaction made on our platform along with the name of the person given to us when the transaction is made on our site. As part of the transaction flow, we include a checkbox that explicitly asks the customer if they are over 18 and are legally allowed to purchase the items they are purchasing.

All of this transaction information is kept in our secured and encrypted databases and we do not distribute this information with anyone.

We're about empowering those rising up in the eSports world and shortening the path to making professional gaming a happy and fruitful livelihood.

Being that we are a community, we wanted to make sure we outline a few guidelines so that everyone can have a good time and get the most out of this platform.

First and foremost, keep it legal

Like many other platforms, we allow for the exchange of information with various groups of people - and to that end it's important that the information being passed is legal to be transmitted and shared. Besides being against the law, any information that is passed through our platform which is illegal is a direct violation of our Community Guidelines as well as our Terms of Use.

Mechanyx.gg enforces a zero-tolerance policy for illegal content. Posting, sharing, or distributing illegal material will result in immediate account termination and potential reporting to law enforcement.

In cases where material damage has been done to Mechanyx.gg, it's systems, image, reputation, or other aspects of the platform and how it operates we will also consider civil legal action as well.

Next, keep it civil and friendly

We're here to have fun and make life easier. And no one likes a killjoy. Therefore, any examples of racist, sexist, ageist, bigotry, hateful, or otherwise rude and misanthropic speech are a violation of our community guidelines.

"racist" speech means any comment, statement, insinuation, expression, communication (verbal or non-verbal) that degrades, harms, threatens, or otherwise disparages an individual or group on the basis of their race, skin color, cultural background or cultural identity.

"sexist" speech means any comment, statement, insinuation, expression, communication (verbal or non-verbal) that degrades, harms, threatens, or otherwise disparages an individual or group on the basis of their biological sex or gender identity.

"ageist" speech means any comment, statement, insinuation, expression, communication (verbal or non-verbal) that degrades, harms, threatens, or otherwise disparages an individual or group on the basis of their age.

"bigotry" means any comment, statement, insinuation, expression, communication (verbal or non-verbal) that is prejudicial to an individual or group because of the fact that the individual or group belongs to a certain group or community. Said another way if someone (or a group) belongs to a community or group, and they are targeted and prejudiced for being in that group, the targeting and subsequent actions against that person are bigotry.

However, Mechanyx.gg fully acknowledges that some groups exist only to antagonize and spread hate. Therefore Mechanyx.gg reserves the right to interpret and use discretion on what is deemed bigotry or not.

It's not a defense to say something to to the effect of "I'm being targeted for being part of this group" when the group is provably hateful or antagonistic.

"hateful" means any comment, statement, insinuation, expression, communication (verbal or non-verbal) that expresses prejudice on the basis of ethnicity, religion, sexual orientation, mental ability or faculties, or other sensitive categories which are not encompassed in any of the sections thus far. Chances is are if something you say threatens or marginalizes someone (or a group) then it's probably a form of hate speech.

"misanthropic" means any comment, statement, insinuation, expression, communication (verbal or non-verbal) that expresses a desire to harm humanity, humankind, or human society.

We all have those days when we "hate the world" or feel like we don't want to deal with people -- but there's a healthy line between having a grumpy day and wanting to harm whole groups of people. Make sure you stay on the side that isn't wanting to harm people.

Those found in violation of our community guidelines regarding the above categories of harmful speech are subject to their accounts being terminated permanently and measures being taken to prevent them from using Mechanyx.gg in the future.

We realize that this is a very subjective matter and the definitions for each of these terms are quite debatable or may lack clear definition. Therefore we encourage you in the case that you are unsure to submit a community guidelines concern case with our community team.

What to do if you feel our community guidelines are being violated

It may be the case that whilst doing your awesome thing using our platform that you find something isn't quite right. Further, whatever it is you are looking at is a breach of our community guidelines. We are happy to take a closer look at these cases because we want everyone to enjoy and play within these guidelines.

Competitive play has been the core of eSports since its inception. Further, even before eSports were a thing, competitions existed between athletes, competitors, spirited individuals, and anyone looking to test their skills.

Competition allows us to draw out some of the best emotions in ourselves and push our bodies, minds, and competitive spirits to new levels. Competition shows us what we can do; and sometimes it shows us that we can do things that we previously thought we couldn't do.

But there's a careful balance to be maintained here -- for far too long eSports has been pegged as a place where, on occasion, people get titled, loose their composure, get salty, toxic, and any other myriad of BM and behavior.

At Mechanyx.gg we are just one of a number of growing companies, brands, and organizations seeking to make eSports a place where all are welcome and healthy competition is encouraged -- without all the toxicity and rough stuff as well.

Whenever you engage with anyone on Mechanyx.gg in a competitive capacity, be it in a tournament, league, or somewhere else on our site, you are expected to maintain a non-toxic and level-headed composure.

There's nothing wrong with a little frustration or wanting to compete at your best. But when that frustration begins to affect others and make them targets you aren't helping anyone. In fact you are stepping backwards when the eSports community is moving forward.

We look forward to a day where eSports gets the competitive and healthy reputation it so deserves - and we think outlining these guidelines allows us to be a part of that conversation and work towards putting the salt mines and barrels of toxic waste in eSports behind us.

Refund Policy: Tournaments and Seasons

We’re excited to offer the opportunity for tournament and league organizers to charge tournament and season entry fees as a way to incentivize their players with prize pools and other tournament resources that these fees go towards.

Naturally because our schedules and lives are always in flux there may come time where you need to withdraw from a tournament or season that had an admission fee and would like to receive a refund.

With all this in mind, we wanted to develop a clear and transparent refund policy and give you some insight into how our payment infrastructure works and what we can do from our end.

Since we have partnered with Stripe to do all of our payment processing securely and easily, we have to play within the realm of their infrastructure and regulations.

When an admission fee is collected, typically the money makes its way to the tournament organizer within 3 business days. Until that time the money is held by Stripe in accordance with IRS and federal guidelines.

To that end if you withdraw your entry from a tournament or season within 2 days (48 hours) of your original entry, you can receive an automated refund in the amount that you paid minus the Mechanyx.gg processing fees.

The reason we cannot refund the Mechanyx.gg processing fee is because Stripe charges us (Mechanyx.gg) a processing fee to make the charge to your card. The Mechanyx.gg processing fee that you pay covers the Stripe processing fee that we get charged and gives us a little extra to keep making Mechanyx.gg the best darn eSports platform out there.

After 2 days, it’s up to the league/tournament staff to decide if they want to refund you as the money has transitioned from Stripe to their account in most cases and we (Mechanyx.gg) have no way to refund it at that point. We recommend speaking with the tournament/league staff to see if they can offer you a refund.

Refund Policy: Donations and Subscriptions through ToTheCause

ToTheCause is, to us, the most robust and fair crowdfunding and subscription platform for creators. We strive to make it the “everything” crowdfunding platform which means that we keep striving to add new features that benefit both creators and their audiences.

Being that the contributions you make to your favorite creators are usually charitable in nature we believe we don’t have much grounds to create a refund on such a contribution as it creates an awkward situation and we believe it to be in poor taste.

However creators can still issue you a refund for their donation through their Stripe dashboard if they so choose. We recommend speaking with the creator you contributed to about your situation and see if they can possibly issue you a refund.
